$40,000 Verdict for Elderly Lady Living in Assisted Living Facility for Slip and Fall on Ice on Her Patio
The assisted living facility denied liability after an elderly female resident stepped outside on her own patio for fresh air one December morning. The assisted living facility and its insurance company refused to pay the elderly lady because she fell upon her own porch -- arguing the facility had no duty to shovel the patios or porches of its residents.
She hired Attorney Jeff Shaw and Shaw Law to dispute that defense.
Attorney Jeff Shaw reviewed all of the snow and ice removal/maintenance contracts of the assisted living facility and discovered that it had promised to take care of "all stoops" relating to the residence.
A Valparaiso, Indiana, jury found that "all stoops" included the back patio and she was awarded over $40,000 for her broken leg.
